Police Se Notice Ya Call Aaya Hai — What It Means and Exactly What To Do

In short: Pehle notice ka section padho. Section 35(3) BNSS (old 41A) = aap sub-7-year offence mein suspect ho — police arrest ki jagah bula rahi hai; appear + cooperate karna hi Arnesh-framework protection hai. Section 179 BNSS (old 160) = aap witness ho. Dono mein ek rule common: ignore kabhi nahi — non-compliance hi arrest ka darwaza kholta hai.

Jaane se pehle counsel ke saath tayyari, saath mein ID + documents, sach bolo par kuch bhi casually sign mat karo. Arrest ka genuine dar ho to appearance date se pehle anticipatory bail.

Before the date — the preparation that actually matters

  1. FIR/complaint nikalwao: kis matter mein bulaya hai, kaunse sections — strategy iske bina impossible.
  2. Timeline likho: apni factual account, dates ke saath, counsel ke saath settle karo — improvised answers hi contradictions bante hain.
  3. Documents chuno: jo aapki account support karein — le jao copies, originals nahi (jab tak specifically maange na jayein).
  4. Assessment: AB chahiye ya nahi — offence 7+ years, ya notice arrest ka prelude lage, to appearance se pehle anticipatory bail; warna cooperative appearance hi best protection.

At the station — do's and don'ts

Do: time pe pahuncho; notice + ID saath; sawalon ke sach, seedhe, chhote jawab; jo yaad nahi use "yaad nahi" bolo (guess mat karo); appearance ki acknowledgment lo ya diary entry ka note rakho. Don't: koi blank ya adhoora padha kagaz sign mat karo; doosron pe theories mat banao; complainant se seedha contact ya settlement ki baat station pe mat karo; phone ka passcode/data demand ho to counsel se pooch ke hi decide karo — devices ke liye alag legal process hota hai. Yaad rakho: S.180 statement sign nahi karaya jaata, par jo bologe wo case-diary mein hamesha rahega.

Jab notice ke peeche kuch aur ho

Teen patterns jo roz dikhte hain: (1) Pressure-notice — civil/money dispute mein samne wala police ke through settlement dabav banwa raha hai; yahan cooperative appearance + likhit reply se record banta hai, aur zaroorat pe quashing ka raasta khulta hai. (2) Matrimonial escalation — 498A/DV ke saath 35(3); appearance ke saath-saath defence file aur family ke liye protection sequence hoti hai. (3) Witness-to-suspect drift — 179 pe gaye the, sawal aap par mudne lage; ye shift pakadna aur usi waqt counsel ko involve karna hi asli bachav hai. Teeno mein ek hi principle: record aapka dost hai jab aap use banate ho, dushman jab wo aapke bina banta hai.

Both notices carry Supreme Court discipline behind them: Arnesh Kumar v. State of Bihar (2014) makes arrest on a Section 35(3)-category offence the exception requiring recorded reasons, and Satender Kumar Antil v. CBI (2022) extends that restraint across offence categories — compliance with the notice is itself protection. And should the notice stage ever collapse into arrest, the D.K. Basu (1997) safeguards — arrest memo, intimation, medical examination — apply in full.
