What is a lookout circular, and who issues it?

A lookout circular is an alert, issued under the Ministry of Home Affairs guidelines at the request of an originating agency such as the police, asking the immigration authorities to detain, stop or report a named person at airports and border points. The person is usually not told in advance; many learn of it only when stopped at departure.

When is a lookout circular lawful?

Courts have held that it is a coercive measure affecting the right to travel abroad under Article 21, so it must have a real basis: a cognizable offence and a person deliberately evading arrest or not appearing in court. Circulars issued in matrimonial disputes against relatives who are cooperating with the investigation, or kept alive after the accused has joined investigation or been granted bail, are regularly quashed.

How is it challenged?

  1. Find the originating agency and FIR, usually from the immigration officer's slip or a representation to the police.
  2. Apply to the agency and the trial court for withdrawal, showing appearance, bail and cooperation.
  3. File a writ petition in the Punjab & Haryana High Court if it is not withdrawn; urgent listing is sought where travel is imminent.

Can a person with a pending case get or renew a passport?

Section 6(2)(f) of the Passports Act allows refusal where criminal proceedings are pending, and Section 10(3)(e) allows impounding. A government notification permits issue or renewal where the court where the case is pending grants permission, usually for a fixed period. A travel permission is an order of the trial court allowing an accused on bail to go abroad, typically on conditions such as an itinerary, a return date and a security amount.
