Case in Delhi, You Live in Faridabad — Which Court Actually Hears Your Matter

The one rule that answers most questions: the case decides, not the address
People in the NCR live in one State and face proceedings in another as a matter of routine — the matrimonial home in Delhi, the parental home in Faridabad, the office in Gurugram. The law’s organising principle is simple once stated: territorial jurisdiction follows the offence and the FIR, not the residence of the accused or the complainant. Faridabad’s district courts answer to the Punjab & Haryana High Court; Delhi’s complexes answer to the Delhi High Court; and which of those ladders your matter climbs is fixed by where the case itself stands registered. Every section below is an application of that rule — including its one deliberate exception.
Delhi FIR ki quashing kahan hogi — Delhi HC ya Chandigarh?
A petition to quash an FIR is filed under Section 528 of the BNSS (the successor to Section 482 CrPC — note the renumbering carefully, because under the new Code “482” now means anticipatory bail, not quashing) before the High Court having jurisdiction over the police station of registration. So: FIR at a Delhi police station — Delhi High Court, even for a Faridabad resident; FIR in Faridabad — Punjab & Haryana High Court, even if every party now lives in Delhi. The grounds — no offence on the face of the FIR, abuse of process, or a genuine settlement in matrimonial matters — are covered in the quashing guide; this page settles only the question of the door you knock on.
Anticipatory bail on a Delhi FIR — and the transit-bail nuance
Apprehending arrest on an FIR registered in Delhi, a Faridabad resident applies for anticipatory bail under Section 482 BNSS before the Delhi Sessions Court or the Delhi High Court — the courts with jurisdiction over the offence. What the courts of your own district can grant is narrower: the Supreme Court has recognised limited transit anticipatory bail — interim protection from the court where the applicant resides, for a short period, precisely so that the person can approach the proper court without being arrested en route (Priya Indoria v. State of Karnataka, 2023). It is a bridge, not a destination: the substantive application still belongs to the courts of the FIR. Treating a transit order as final protection is a mistake with consequences.
The matrimonial exception: the shelter-forum rule
Cruelty cases run on a different and deliberate track. In Rupali Devi v. State of U.P. (2019) 5 SCC 384, a three-Judge Bench held that the courts at the place where the wife takes shelter after leaving the matrimonial home on account of cruelty also have jurisdiction — because the mental cruelty and its consequences travel with her. In NCR terms: matrimonial home in Delhi, wife now sheltered with her parents in Faridabad — the complaint can be pursued in Faridabad; and equally, a wife sheltered in Delhi can proceed there against a Faridabad matrimonial home. Both sides of a matrimonial file should read the Delhi matrimonial guide and the defence guide with this rule in mind — the forum fight that once opened every such case is largely settled law now.
Zero FIR — the border is not a wall
Under the BNSS, information disclosing a cognizable offence can be recorded at any police station, irrespective of territorial jurisdiction, as a Zero FIR, and transferred to the competent station — statutory now, not merely a circular. A Faridabad resident wronged in Delhi need not travel to the Delhi police station to set the law in motion, and vice versa. In cyber-fraud matters the machinery has gone further: complaints on the national portal and the 1930 helpline above a notified monetary threshold are auto-registered through Delhi’s e-FIR system and routed onward — which is one more reason the account-freeze guide’s golden-hour advice matters more than geography.
Police notice from the other side of the border
A notice of appearance under Section 35(3) BNSS (the old 41A CrPC) from a Delhi police station is fully valid against a Faridabad resident — investigation follows the case, not the border. The discipline is the same as ever: comply, appear or respond in writing as the notice directs, take advice before the appearance where the allegation is serious, and remember that compliance itself is protective — the police-notice guide covers the sequence. Transfers, and the honest limits of forum-shopping
Where the interests of justice genuinely require it, a case can be moved: the BNSS carries forward the transfer framework (Sections 446–448, the successors to Sections 406–408 CrPC) — the Supreme Court for inter-State transfers, the High Court within a State. Courts grant these sparingly, on demonstrated grounds — distance and inconvenience alone rarely suffice, and matrimonial transfers are weighed with the wife’s circumstances prominently in view. The realistic advice for anyone straddling the NCR: plan the forum questions at the start with the rules above, rather than litigating them for two years in between.
The third corner: Noida, Greater Noida and Ghaziabad — a different High Court entirely
The NCR’s U.P. districts run on a separate appellate stream from everything above. A Gautam Buddh Nagar or Ghaziabad FIR escalates to the High Court of Judicature at Allahabad — and specifically to its principal seat at Prayagraj, not the Lucknow bench, whose jurisdiction is confined to the Awadh-region districts. For a Delhi or Faridabad resident with a case in Noida or Ghaziabad, neither the Delhi High Court nor the Punjab & Haryana High Court has any role: quashing under Section 528 BNSS and any writ relief go to Prayagraj. Anticipatory bail follows the same U.P. stream — the Sessions Court or the Allahabad High Court under Section 482 BNSS, not the courts of the applicant’s home State. As with the Delhi-Haryana corner, the applicant’s own district can grant only limited transit protection to reach the proper forum, on the same Priya Indoria footing set out above — a bridge, not a substitute for the U.P. application. One current fact worth knowing precisely: U.P.’s 2019 State amendment had barred anticipatory bail for the gravest offences, but the Allahabad High Court has since held that Section 482 BNSS, being a central enactment, prevails over the 2019 State bar — so anticipatory bail is again available in U.P. on the ordinary BNSS terms in the cases so far decided. This is recent, High-Court-level law rather than a settled Supreme Court position, and worth confirming afresh with counsel at the time of filing. Noida and Ghaziabad also operate under the police commissionerate system rather than the district-SP model — it changes who signs certain orders, not the forum rules above.
