This page explains the civil courts at Faridabad, the routes for recovering money, injunction and declaration suits, limitation, execution of decrees, and what to bring to a first meeting.
Civil advocate in Faridabad — which court hears a civil suit?
A civil suit is a case started by a plaint asking a court for money, possession, a declaration or an order to do or stop doing something. A pecuniary limit is the money value up to which a court may hear a suit. Faridabad's civil courts sit at the District Courts, Sector 12, with civil judges and additional district judges hearing suits by value, and appeals going to the district judge or the Punjab & Haryana High Court.
| Dispute | Route | Forum |
|---|---|---|
| Money due on a written contract, invoice or cheque | Summary suit, Order 37 CPC | Civil court by value |
| Other money claims, damages, refund | Ordinary money suit | Civil court by value |
| Commercial dues of specified value (₹3 lakh and above) | Commercial suit after pre-institution mediation (Section 12A) | Commercial court |
| Stop a sale, construction or interference | Injunction, Order 39 CPC and Sections 38–39 Specific Relief Act | Civil court |

Recovery suit lawyer in Faridabad — the three routes
- Legal notice: a dated demand with the amount, basis and deadline. It often settles the matter and fixes the record for interest.
- Summary suit under Order 37: for debts on written contracts, bills or cheques. The defendant cannot defend without the court's leave, so weak defences end early.
- Ordinary suit: where the claim needs full evidence. Interest during the suit and after decree is awarded under Section 34 CPC.
A dishonoured cheque also supports a criminal complaint; see cheque bounce lawyer in Faridabad. MSME suppliers can instead approach the MSME Facilitation Council for delayed payments; see commercial and arbitration lawyer.
Injunction case lawyer in Faridabad — urgent protection
A temporary injunction preserves the position while the suit is decided. The court checks three things: a prima facie case, the balance of convenience, and irreparable injury if the order is refused. In urgency it can act before notice under Order 39, Rule 3. Disobedience is punishable under Order 39, Rule 2A, including attachment of property. Expecting an injunction suit against you? A caveat under Section 148A CPC ensures you are heard first.
Limitation — the deadlines that decide civil cases
| Claim | Limitation |
|---|---|
| Money due on a contract, goods sold, services | 3 years, Limitation Act |
| Declaration | 3 years from when the right to sue first accrues |
| Specific performance | 3 years from the date fixed, or from refusal |
| Possession based on title | 12 years from adverse possession |
| Possession after dispossession without due process (Section 6 SRA) | 6 months |
| Execution of a decree for money | 12 years |
Execution — turning a decree into money
A decree is the court's formal order deciding the suit. If the losing side does not pay, the decree-holder files execution under Order 21 CPC. The court can attach bank accounts and property, order a sale, and in some cases arrest the judgment-debtor. Many recoveries are actually won at this stage, so the plaint should be drafted with execution in mind.
How to choose an advocate for this matter in Faridabad
- Enrolment: ask for the enrolment number and State Bar Council. Under Section 30 of the Advocates Act, 1961 an enrolled advocate may appear in any court in India.
- Forum presence: check appearances before the court concerned on the eCourts portal.
- Candour: a reliable advocate tells you the weak points of the file, not a promised result.
- Written terms, stage by stage; costs are explained in the lawyer fees guide.
Rule 36 of the Bar Council of India Rules forbids any advocate from claiming to be the "best", "top" or "No. 1" in Faridabad. Those words in a search are best answered by the tests above.
