Consumer complaint lawyer in Delhi — which commission?
A consumer is a person who buys goods or hires services for consideration, other than for resale or commercial purpose. Complaints are about deficiency in service, defective goods, unfair trade practices or overcharging.
| Consideration paid | Forum |
|---|---|
| Up to ₹50 lakh | District Consumer Disputes Redressal Commission |
| Above ₹50 lakh, up to ₹2 crore | Delhi State Consumer Disputes Redressal Commission |
| Above ₹2 crore | National Consumer Disputes Redressal Commission |
Under Section 34(2) of the Consumer Protection Act, 2019, a complaint may be filed where the complainant resides or personally works for gain, as well as where the opposite party is. Delhi has several District Commissions, each for specified revenue districts.
How a consumer complaint runs in Delhi
- Limitation: within two years from when the cause of action arose (Section 69); delay can be condoned for sufficient cause.
- Filing: online on e-Daakhil or at the Commission; nil fee for claims up to ₹5 lakh.
- Admission within 21 days; then notice to the opposite party, who has up to 45 days to reply.
- Evidence by affidavit and arguments. Reliefs under Section 39 include refund, replacement, compensation, punitive damages and costs.
- Appeal to the next Commission within 45 days, after depositing 50% of the amount ordered.
Typical Delhi complaints: builder delay and defects, insurance claims repudiated, hospital and medical negligence, airline and travel refunds, online purchases, bank charges and education services. See also insurance claim rejected and filing on e-Daakhil.
Motor accident claim lawyer in Delhi — the MACT
Motor Accident Claims Tribunals sit at the Delhi district complexes and decide compensation for death, injury and damage under the Motor Vehicles Act, 1988. The police file a Detailed Accident Report, which is treated as a claim application. A separate claim under Section 166 must be filed within six months of the accident. It may be filed where the accident occurred, where the claimant lives or works, or where the defendant lives. A no-fault claim under Section 164 gives fixed compensation of ₹5 lakh for death and ₹2.5 lakh for grievous hurt without proving negligence. Compensation in fault claims is worked out by the multiplier method on income and age; see MACT claims explained.
Labour court and employment lawyer in Delhi
Since 21 November 2025, the four labour codes have replaced most earlier labour statutes. Industrial disputes of workers, such as termination, retrenchment and dues, are raised under the Industrial Relations Code, 2020 before the conciliation machinery and then the Industrial Tribunal. Gratuity and social-security claims fall under the Code on Social Security, 2020. Managerial and supervisory employees outside those definitions usually sue on their employment contract: salary arrears through a summary suit, wrongful termination through a civil or commercial suit. Sexual harassment complaints at work go to the employer's Internal Committee, or the District Officer's Local Committee, under the POSH Act, 2013; see POSH complaints.
Common consumer disputes in Delhi — what the commission looks at
- Builder and housing: delayed possession, refund with interest, defects and unfair one-sided clauses in the buyer agreement.
- Insurance: health, motor and life claims rejected on non-disclosure or exclusion clauses. The commission examines whether the ground was disclosed and proved by the insurer.
- Medical negligence: whether the doctor or hospital fell below the standard of a reasonably competent practitioner. Expert evidence and medical records decide most cases.
- E-commerce and travel: refunds for cancelled flights, undelivered goods and misleading listings, including against platforms under the E-Commerce Rules, 2020.
- Banking and education: unauthorised debits, wrongful charges, and refund of fees on withdrawal.
How to choose a consumer court advocate in Delhi
- Forum accuracy: the right commission by value and place avoids a return of the complaint.
- Evidence-first drafting: the complaint should attach the proof of payment, the deficiency and every written refusal.
- Realistic relief: refund, interest and compensation framed as the Act allows, not inflated figures.
- Written terms, stage by stage.
First consultation — what to bring
Consumer: bills, policy or allotment papers, correspondence and the refusal. Accident: FIR number, medical papers, income and age proof, and vehicle and insurance details. Employment: appointment letter, salary slips, the termination letter and emails. Costs are explained in the lawyer fees guide.
Frequently asked questions
Where do I file a consumer complaint in Delhi?
Before the District Commission covering the area where you live or work, or where the opposite party carries on business, if the amount paid is up to ₹50 lakh. Above that, the Delhi State Commission or the National Commission hears it.
Is a lawyer necessary in a Delhi consumer case?
No. A consumer can file and argue personally. Advocates are engaged where the claim is large, the opposite party is represented, or evidence on deficiency and compensation needs careful presentation.
What is the time limit for a motor accident claim in Delhi?
Section 166(3) of the Motor Vehicles Act requires a claim within six months of the accident. The police Detailed Accident Report is also treated as a claim application before the tribunal.
Which court hears labour cases in Delhi?
Industrial disputes of workers go through conciliation and then to the Industrial Tribunal under the Industrial Relations Code, 2020. Contract claims of managerial employees go to the civil or commercial courts.
Can I claim compensation if the insurance company rejected my claim in Delhi?
Yes. A wrongful repudiation is a deficiency in service; the policyholder can approach the Insurance Ombudsman or file a consumer complaint for the claim amount, interest and compensation.
How long does a consumer case take in Delhi?
The Act targets disposal within three months of notice to the opposite party, or five months where goods need testing. Actual time depends on the commission's workload, adjournments and whether evidence is contested.
Can I file a consumer complaint against an online shopping platform in Delhi?
Yes. Sellers and, in defined cases, e-commerce platforms are answerable for deficiency and unfair trade practices, and the complaint can be filed where the consumer lives or works.
