Family court lawyer in Noida — where can the case be filed?

Under Section 19 of the Hindu Marriage Act, a divorce petition can be filed where the marriage was solemnised, where the respondent lives, where the couple last lived together, or where the wife lives if she is the petitioner. A couple whose last home was in Noida, Greater Noida West or Noida Extension files before the family courts of Gautam Buddh Nagar at Surajpur. Many Noida couples married in Delhi or have family in Ghaziabad, so the choice of forum is often the first decision.

Mutual and contested divorce

  1. One year's separation before a mutual petition.
  2. Settlement terms on alimony, stridhan, custody and other pending cases.
  3. First motion under Section 13B(1), then the second motion after six months, which the court may waive in suitable cases.
  4. Decree.

Contested divorce runs on the grounds in Section 13, such as cruelty, desertion and adultery, with mediation, pleadings and evidence. See mutual divorce documents.

Custody, domestic violence and dowry complaints

Custody petitions go to the family court, with the child's welfare as the test; legal and physical custody may be split, and visitation fixed. Domestic violence applications under the DV Act, 2005 seek protection, residence and monetary orders from the Magistrate at Surajpur. Cruelty and dowry complaints under Section 85 BNS and the Dowry Prohibition Act usually pass through the police women's cell first. The chamber acts for one side only in any matter. See 498A defence guide.

Noida, Delhi or Ghaziabad — which state's court?

Noida sits in Uttar Pradesh, so its courts follow the Allahabad High Court, while Delhi has its own High Court. A dispute that touches both, for example a Delhi marriage with a Noida home, or a Noida company paying a Delhi vendor, can often be filed in more than one place. The deciding facts are where the cause of action arose, where the parties live, and, for cheques, where the payee banks. Choosing the forum carefully at the start avoids a transfer later. See NCR courts.

How to choose an advocate for this matter in Noida

  1. Enrolment: ask for the enrolment number and State Bar Council. Under Section 30 of the Advocates Act, 1961 an enrolled advocate may appear in any court in India.
  2. Forum presence: check appearances before the court concerned on the eCourts portal.
  3. Candour: a reliable advocate tells you the weak points of the file, not a promised result.
  4. Written terms, stage by stage; costs are explained in the lawyer fees guide.

Rule 36 of the Bar Council of India Rules forbids any advocate from claiming to be the "best", "top" or "No. 1" in Noida. Those words in a search are best answered by the tests above.

First consultation in a Noida family matter — what to bring

Marriage proof, addresses of both spouses since marriage, children's details, income proof, a list of stridhan and gifts, any complaint, FIR or notice, and earlier court orders.
