Maintenance is a periodic payment for food, shelter, clothing, education and medical care. Alimony is maintenance ordered between spouses, either during the case (interim) or with the divorce (permanent, as a lump sum or monthly). Parents and senior citizens can also claim from children under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007; see parents' maintenance.

How does the Faridabad Family Court decide the amount?

  1. Disclosure: both sides file an affidavit of assets and liabilities, as the Supreme Court required in Rajnesh v. Neha (2020).
  2. Income: salary slips, ITRs, business records and lifestyle evidence. Concealed income can be inferred from spending.
  3. Needs and status: the standard of living during the marriage, the children's schooling and medical needs, and the wife's own income.
  4. Obligations: the husband's dependants and genuine liabilities.

What are interim maintenance and child support?

Interim maintenance can be ordered within weeks of filing, to cover living costs and litigation expenses while the case runs. Child support covers the child's education, health and upkeep and is decided on the child's needs, not on the parents' dispute. A parent with custody claims it for the child, and it usually continues until majority, longer for a child who cannot maintain themself.

What happens when maintenance payments stop?

Under Section 144(3) BNSS, the Family Court can issue a warrant to recover arrears as a fine, and can send the defaulting person to prison for up to one month for each month's unpaid amount. The application for arrears should be made within one year of the amount falling due. Salary attachment is also used for employed husbands.

How can a husband contest a maintenance claim?

A husband can contest the claim: the wife's own sufficient income, desertion without reason, false income claims, or a prior settlement. He can also seek reduction when his circumstances change, under Section 146 BNSS. The chamber acts for one side only in any matter.

How soon is interim maintenance granted?

Applications are usually decided early in the case on the affidavits, and courts aim to decide them within weeks. Arrears are payable from the date of application unless the court orders otherwise.

What happens if the husband does not pay maintenance?

Can a working wife claim maintenance?

Yes, if her income is not enough to maintain the standard of living she had in the marriage. Her income is weighed against the husband's when fixing the amount.

Is alimony paid as a lump sum or monthly?

Either. Permanent alimony under Section 25 of the Hindu Marriage Act may be a one-time settlement or periodic payments, and mutual divorces usually record a lump-sum figure.
