Builder delay in Noida and Greater Noida — UP RERA

Under Section 18 of the Real Estate (Regulation and Development) Act, 2016, a buyer in a delayed project may withdraw with a refund and interest, or stay and receive interest for each month of delay. Complaints are filed with UP RERA under Section 31. Orders that are not obeyed are enforced as arrears of land revenue through the district administration, and execution is where many Noida cases are decided. A consumer complaint is an alternative remedy, but the same relief should not be sought in both forums.

Leasehold land and title checks in Noida

Most Noida and Greater Noida property sits on land leased by the development authorities, so a buyer acquires leasehold rights subject to the lease terms, not freehold. Before buying, check:

  • the lease or sub-lease deed and the chain of transfers, with the authority's transfer permissions;
  • dues payable to the authority and the builder's dues that may block registry;
  • completion or occupancy certificate, and the project's UP RERA registration;
  • for village land, the khatauni (revenue record of rights) and mutation;
  • encumbrances and pending litigation.

Buyers in projects where the sub-lease has not been executed face a registry delay, which is a frequent ground for complaints.

Partition, injunction and tenancy

Co-owners of urban property seek partition by suit before the civil courts at Surajpur. The court declares shares, then divides the property. Agricultural holdings are divided before the revenue courts. A temporary injunction under Order 39 CPC protects property while a suit is pending. Tenancies in UP are governed by the 2021 Act, which requires a written tenancy agreement and sends disputes to the Rent Authority, with appeal to the Rent Tribunal.

Noida, Delhi or Ghaziabad — which state's court?

Noida sits in Uttar Pradesh, so its courts follow the Allahabad High Court, while Delhi has its own High Court. A dispute that touches both, for example a Delhi marriage with a Noida home, or a Noida company paying a Delhi vendor, can often be filed in more than one place.
