What does a cheating case actually require in law?
Section 318 BNS keeps the classical structure: deception of a person, dishonest or fraudulent inducement, and — for the aggravated form in sub-section (4) — delivery of property or alteration/destruction of valuable security as a result. The provision also expressly reaches deception through electronic and digital means, reflecting how much of this offence now happens over UPI transfers, trading apps, and WhatsApp.
The ingredient courts examine hardest is the state of mind at the time the representation was made. Mere breach of a promise, mere inability to repay, mere commercial failure — none of these is cheating unless dishonest intent existed at the beginning. This distinction decides most 318/420 files long before trial.

A significant share of cheating FIRs in the NCR arise from business fallouts, unpaid dues, and property deals — situations that are contractual at their core, filed as criminal cases to apply pressure. The Supreme Court has criticised this pattern in strong terms: in Ramesh Kumar v. State (NCT of Delhi), 2023, it deprecated cheating cases being run as money-recovery proceedings and held that bail cannot be conditioned on depositing the disputed amount.
The defence toolkit follows from the ingredients: anticipatory bail under Section 482 BNSS where arrest is apprehended; a considered reply at the notice/investigation stage; and, where the FIR on its own face discloses only a contractual dispute, a quashing petition under Section 528 BNSS before the High Court — the same route explained in the FIR quashing guide. If you are the complainant — filing a case that survives scrutiny
A genuine cheating complaint is built on the money trail and the timeline: bank and UPI records, the representations as actually made (messages, emails, recordings where lawfully available), and material showing the accused’s position at the time of the promise — for instance, that the thing promised never existed or was already sold. The FIR route runs through the police; if the police do not register it, the escalation ladder up to the Magistrate under Section 175(3) BNSS remains open.
One expectation should be set honestly at the outset: a criminal case is a punishment track, not a recovery decree. Money comes back through settlement/compounding, or through the civil side — a recovery suit, a summary suit where the claim fits, or the consumer forum where the relationship qualifies. A well-planned matter often runs the criminal and civil tracks in parallel, each doing its own job.
Bail in Section 318 cases
Being non-bailable means bail is a judicial decision, not a right exercised at the police station — it does not mean bail is unlikely. Courts weigh the nature of the allegation, the documentary character of the evidence (most cheating evidence is on paper and cannot be tampered with by liberty), roots in the community, and cooperation with investigation. Anticipatory bail, applied for at the right moment with the transaction documents properly presented, is the standard protective step where an FIR is anticipated; the principles from Ramesh Kumar protect against deposit-style conditions.
Settlement and compounding
Cheating is compoundable by the person cheated with the permission of the court (Section 359 BNSS carries forward the scheme). In practice, a large fraction of these matters resolve by settlement — the complainant recovers, the accused closes the criminal exposure, and the court records the compromise. Where a particular charge in the FIR is technically non-compoundable, High Courts routinely quash proceedings on the basis of a genuine settlement in private commercial disputes. Structuring that settlement so it actually ends the matter is lawyer’s work.

Is a 420 case bailable or not?
Non-bailable — bail is granted by the court, not at the police station. That does not make bail unlikely; in documentary-evidence cases with a cooperative accused, regular or anticipatory bail is commonly granted. The Supreme Court has also held bail cannot be conditioned on depositing the disputed money.

Not directly — a criminal court punishes, it does not pass a recovery decree. Recovery comes through settlement/compounding or through the civil side (recovery suit, summary suit, consumer forum). Many matters run both tracks in parallel.
What has replaced Section 420 IPC?
Section 318(4) of the Bharatiya Nyaya Sanhita, 2023, for offences on or after 1 July 2024. Earlier acts continue under Section 420 IPC. The punishment ceiling — seven years plus fine — is unchanged, and the new provision expressly covers electronic and digital deception.
What is the difference between cheating and breach of contract?
Intention at the start. If the promisor intended to perform and later failed, it is breach of contract — a civil matter for damages. Cheating requires proof of dishonest or fraudulent intention at the very inception of the transaction. Courts examine this ingredient before anything else.
