What changed in October 2026?
The Bankers' Books Evidence Act, 2026 is a new statute, assented to on 13 August 2026 and in force from 1 October 2026, that replaces the Bankers' Books Evidence Act, 1891. A certified copy of a bank entry is a copy of a bank record that a bank officer certifies as correct, which courts accept as evidence without producing the original books.
- Technology-neutral records: bank records kept in physical, electronic, digital, virtual or cloud form are covered.
- Digital certification: certificates may carry manual, digital or electronic signatures.
- Bank officials as witnesses: where the bank is not a party, a court must record a special reason in writing before summoning a bank officer.
- Wider reach: the government may extend the Act to other financial-sector entities.

Does a new law apply to a case that is already pending?
It depends on the kind of law. A new offence or a higher punishment never applies to acts done before it, under Article 20(1) of the Constitution. Criminal cases pending on 1 July 2024 continue under the CrPC by the saving clause in Section 531 BNSS. Procedural and evidence rules, such as how a bank record is proved, generally apply to pending cases from their commencement unless the new law says otherwise. Check the stage of your case before relying on a change.
