Last updated: 2 October 2026 · Reflects the BNS/BNSS, 2023 · By Advocate Manish Sharma · General legal information, not legal advice

In short: A Section 138 cheque-bounce complaint lies before the Magistrate where the payee's bank branch is, so Gurugram accounts mean the Gurugram courts. Consumer complaints up to ₹50 lakh go to the District Commission, Gurugram, and accident claims to the Motor Accident Claims Tribunal there. Advocate Manish Sharma takes these matters from the Faridabad chamber.

This page covers cheque bounce and money recovery, consumer complaints, motor accident claims and employment disputes in Gurugram: the forum, the deadlines and what to bring.

Under Section 142(2), the complaint lies where the payee's bank branch holding the account is situated, whatever the drawer's address. See cheque bounce lawyer in Faridabad for the full trial sequence.

Money recovery and business disputes in Gurugram

A cheque complaint punishes the dishonour; it does not by itself decree the debt. Recovery runs alongside it: a summary suit under Order 37 CPC on a written contract or cheque, where the defendant needs leave to defend; a commercial suit for commercial dues of specified value, after pre-institution mediation under Section 12A of the Commercial Courts Act, 2015; and the Debts Recovery Tribunal for bank dues of ₹20 lakh and above. Vendor defaults, unpaid invoices and founder disputes in Gurugram's corporate corridor mostly run on these tracks.

Consumer complaints in Gurugram

The District Consumer Disputes Redressal Commission, Gurugram hears complaints where the consideration paid is up to ₹50 lakh. The Haryana State Commission hears those up to ₹2 crore, and the National Commission those above. A complaint is filed within two years, where the consumer lives or works, online through e-Daakhil, with nil fee up to ₹5 lakh. Common Gurugram complaints concern builders, insurers, hospitals, airlines, online sellers and banks. See filing on e-Daakhil.

Motor accident claims at the Gurugram MACT

Accident compensation is decided by the Motor Accident Claims Tribunal. A claim under Section 166 of the Motor Vehicles Act, 1988 must be filed within six months of the accident, where it happened or where the claimant or defendant lives. The police Detailed Accident Report is also treated as a claim. A no-fault claim under Section 164 gives ₹5 lakh for death and ₹2.5 lakh for grievous hurt. See MACT claims explained.

Employment and labour disputes in Gurugram

Since 21 November 2025, the four labour codes have replaced most earlier labour statutes. Workers raise disputes about termination, retrenchment and dues under the Industrial Relations Code, 2020, through conciliation and then the Industrial Tribunal. Managerial employees usually sue on their contracts for unpaid salary, notice pay or wrongful termination. POSH complaints go to the employer's Internal Committee. See employment law in the NCR.

Gurugram, Faridabad or Delhi — which court?

Gurugram and Faridabad are both in Haryana and share the Punjab & Haryana High Court, while Delhi has its own. A dispute that touches two cities, for example a Delhi marriage with a Gurugram home, or a Gurugram company paying a Faridabad vendor, can often be filed in more than one place. The deciding facts are where the cause of action arose, where the parties live, and, for cheques, where the payee banks. See Delhi or Haryana — which court?.

How to choose an advocate for this matter in Gurugram

  1. Enrolment: ask for the enrolment number and State Bar Council. Under Section 30 of the Advocates Act, 1961 an enrolled advocate may appear in any court in India.
  2. Forum presence: check appearances before the court concerned on the eCourts portal.
  3. Candour: a reliable advocate tells you the weak points of the file, not a promised result.
  4. Written terms, stage by stage; costs are explained in the lawyer fees guide.

Rule 36 of the Bar Council of India Rules forbids any advocate from claiming to be the "best", "top" or "No. 1" in Gurugram. Those words in a search are best answered by the tests above.

First consultation — what to bring

Cheque: original cheque, return memo, notice and postal proof, and the documents showing the debt. Consumer: bills, policy or allotment papers and the refusal. Accident: FIR, medical papers, income and age proof. Employment: appointment letter, salary slips, termination letter and emails.
