Cheque bounce lawyer in Noida — the Section 138 deadlines
| Step | Time limit | Provision |
|---|---|---|
| Present the cheque | Within its validity, ordinarily 3 months | Section 138(a) |
| Legal notice of demand | Within 30 days of the return memo | Section 138(b) |
| Drawer's window to pay | 15 days from receipt of notice | Section 138(c) |
| Complaint before the Magistrate | Within 1 month after the 15 days | Section 142(1)(b) |
| Interim compensation | Up to 20% of the cheque amount | Section 143A |
Under Section 142(2), the complaint lies where the payee's bank branch holding the account is situated. For a payee banking in Noida or Greater Noida, that is the Magistrate at Surajpur, wherever the drawer lives. The presumption of debt under Section 139 must be rebutted by the drawer. The offence is bailable and compoundable. See cheque bounce and recovery.
Money recovery and business disputes
Alongside the criminal complaint, money is recovered through a summary suit under Order 37 CPC, a commercial suit after pre-institution mediation under Section 12A of the Commercial Courts Act, 2015, or, for bank dues of ₹20 lakh and above, the Debts Recovery Tribunal. Borrowers can challenge SARFAESI measures before the Tribunal under Section 17 within 45 days.
Consumer complaints in Noida
The District Consumer Disputes Redressal Commission, Gautam Buddh Nagar hears complaints up to ₹50 lakh. The UP State Commission hears those up to ₹2 crore, and the National Commission those above. File within two years, where you live or work, online through e-Daakhil, with nil fee up to ₹5 lakh. Builder, insurance, hospital, online-purchase and bank disputes are the common Noida categories. See filing on e-Daakhil.
Motor accident claims
The Motor Accident Claims Tribunal for Gautam Buddh Nagar decides compensation for death, injury and damage. A claim under Section 166 of the Motor Vehicles Act, 1988 must be filed within six months of the accident, where it happened or where the claimant or defendant lives. The police Detailed Accident Report is also treated as a claim. No-fault compensation under Section 164 is ₹5 lakh for death and ₹2.5 lakh for grievous hurt. Expressway accidents often involve claimants from other states, who may file where they live.
Employment disputes in Noida
Since 21 November 2025, the four labour codes govern most workplace disputes. Workers raise termination and dues disputes under the Industrial Relations Code, 2020 through the conciliation machinery. Managerial employees usually sue on their contracts. POSH complaints go to the employer's Internal Committee. See employment law in the NCR.
Noida, Delhi or Ghaziabad — which state's court?
Noida sits in Uttar Pradesh, so its courts follow the Allahabad High Court, while Delhi has its own High Court. A dispute that touches both, for example a Delhi marriage with a Noida home, or a Noida company paying a Delhi vendor, can often be filed in more than one place. The deciding facts are where the cause of action arose, where the parties live, and, for cheques, where the payee banks. Choosing the forum carefully at the start avoids a transfer later. See NCR courts.
How to choose an advocate for this matter in Noida
- Enrolment: ask for the enrolment number and State Bar Council. Under Section 30 of the Advocates Act, 1961 an enrolled advocate may appear in any court in India.
- Forum presence: check appearances before the court concerned on the eCourts portal.
- Candour: a reliable advocate tells you the weak points of the file, not a promised result.
- Written terms, stage by stage; costs are explained in the lawyer fees guide.
Rule 36 of the Bar Council of India Rules forbids any advocate from claiming to be the "best", "top" or "No. 1" in Noida. Those words in a search are best answered by the tests above.
First consultation — what to bring
Cheque: original cheque, return memo, notice and postal proof, and documents showing the debt. Consumer: bills, policy or allotment papers and the refusal. Accident: FIR, medical papers, income and age proof. Employment: appointment letter, salary slips and the termination letter.
