Criminal advocate in Gurgaon — which court hears what?

A Sessions-triable offence is a serious offence that the First Schedule of the BNSS assigns to the Court of Session. Other offences are tried by a Magistrate. In Gurugram both sit at the district court complex, and the police station named in the FIR fixes the court.

Gurugram and Faridabad share the same High Court, so a bail file can move from the Sessions Court to Chandigarh without changing counsel. The urgent sequence is set out in urgent anticipatory bail.

FIR, police notice and quashing

A police notice under Section 35 BNSS asks a person to appear before the investigating officer. It must be answered, and ignoring it can lead to arrest. A Zero FIR under Section 173 BNSS can be lodged at any police station and is transferred to the one with jurisdiction. Where an FIR is false, or a private dispute has been genuinely settled, the Punjab & Haryana High Court can quash it under Section 528 BNSS. The district court cannot. See FIR quashing and police notice — what to do.

Cyber fraud, cheating and economic offences in Gurugram

Online fraud victims should call the national cyber-crime helpline 1930 at once and file a complaint. Speed decides whether the money trail can be frozen. Gurugram's cyber police stations investigate these cases. Accused persons and innocent account holders whose bank accounts are frozen have separate remedies; see bank account frozen by cyber cell. Cheating and criminal breach of trust under Sections 318 and 316 BNS are common in Gurugram's corporate corridor. Many such FIRs are really civil disputes, which is a recognised ground for quashing.

NDPS, POCSO and other special-court matters

NDPS cases carry the bail restrictions of Section 37 for commercial quantity, and POCSO cases are tried in camera by special courts. In both, the first bail application and the charge stage need the most care. See NDPS bail; the same law applies in Gurugram.

Gurugram, Faridabad or Delhi — which court?

Gurugram and Faridabad are both in Haryana and share the Punjab & Haryana High Court, while Delhi has its own. A dispute that touches two cities, for example a Delhi marriage with a Gurugram home, or a Gurugram company paying a Faridabad vendor, can often be filed in more than one place. The deciding facts are where the cause of action arose, where the parties live, and, for cheques, where the payee banks. See Delhi or Haryana — which court?.

How to choose an advocate for this matter in Gurugram

  1. Enrolment: ask for the enrolment number and State Bar Council. Under Section 30 of the Advocates Act, 1961 an enrolled advocate may appear in any court in India.
  2. Forum presence: check appearances before the court concerned on the eCourts portal.
  3. Candour: a reliable advocate tells you the weak points of the file, not a promised result.
  4. Written terms, stage by stage; costs are explained in the lawyer fees guide.

Rule 36 of the Bar Council of India Rules forbids any advocate from claiming to be the "best", "top" or "No. 1" in Gurugram. Those words in a search are best answered by the tests above.

First consultation in a Gurugram criminal matter — what to bring

The FIR or complaint, the police station and sections, any notice or summons, arrest memo and remand orders, bail orders already passed, and a dated timeline. Keep messages, call records and bank entries intact; do not delete anything.
