Kaunsa Lawyer Chahiye? — From Your Problem to the Right Practice Area

Last updated: 31 July 2026 · By Advocate Manish Sharma, Faridabad · General legal information, not legal advice

In short: The fastest way to find the right lawyer is to classify the problem, not the person. Freedom or jail risk — FIR, arrest, police notice, bail — is criminal-defence work. Money and property — recovery, possession, contracts, registry — is civil work. Marriage and children — divorce, maintenance, custody, domestic violence — is matrimonial/family work.

Job and workplace — termination, wages, POSH — is labour and employment work. Accidents run before the MACT, and defective goods and services before the consumer forum. Many real disputes sit in two boxes at once — a cheque bounce is criminal and a recovery problem — and recognising the overlap early is half the strategy.

Forum thresholds do the sorting: consumer claims to ₹50 lakh sit in the District Commission and to ₹2 crore in the State Commission (2021 Jurisdiction Rules), cheque-bounce complaints follow the payee’s bank branch, and criminal matters follow the FIR’s police station.

Two structural facts simplify every choice: enrolment under the Advocates Act, 1961 is all-India (Section 30), and consumer matters up to ₹50 lakh sit in the District Commission (2021 Jurisdiction Rules) — so the question is court-family fit, not city.

Freedom or jail risk — is this a criminal matter?

An FIR naming you, a police notice, an arrest in the family, a bail or anticipatory-bail situation, a marpit case, a cheating allegation, a drink-drive challan — anything where the State prosecutes and liberty is the stake belongs to criminal-defence practice. The same practice area serves the other side too: complainants pursuing an FIR and its investigation.

Money, property and contracts — civil practice

Recovery of dues, possession and eviction, breach of contract, registry and title questions, partition, injunctions, and succession are civil-court work. One frequent overlap: a cheque bounce is prosecuted as a criminal complaint under Section 138 NI Act while the underlying money remains a civil recovery question — the two tracks are often run together deliberately.

Marriage and children — matrimonial and family practice

Divorce, maintenance, custody, domestic-violence proceedings, court marriage and live-in questions, and 498A matters from either side sit before the Family Court and the criminal courts’ matrimonial dockets. This is the practice area where criminal and family law intertwine most — which is why one chamber handling both lenses matters.

Job and workplace — labour and employment practice

Termination, unpaid wages, full-and-final disputes, POSH matters and PF-ESIC questions route through conciliation, the Labour Court and statutory authorities depending on the role and the claim — the forum question here is genuinely technical, and getting it right at the start saves months.

Accidents and consumer grievances — MACT and the consumer forum

Road-accident injury and death claims run before the Motor Accidents Claims Tribunal on structured compensation principles. Defective products, deficient services, rejected insurance claims and builder disputes route to the consumer commissions (e-Daakhil) and, for real estate, RERA — often faster and cheaper than a civil suit for the same grievance.

When the problem sits in two boxes

The hardest calls are the overlaps: a business fraud that is both a criminal cheating case and a civil recovery; a matrimonial breakdown carrying an FIR; an employment exit with both dues and a defamation angle. The honest sequence is always the same — classify every strand, choose the forum for each, and decide what runs in parallel and what waits. That mapping conversation is the single most valuable thing to have with a lawyer before anything is filed, and it is far cheaper than filing in the wrong forum.

Frequently asked questions

Kya ek hi lawyer alag-alag courts aur shehron me case lad sakta hai?

Haan — Advocates Act, 1961 ka Section 30 enrolled advocate ko desh ke har court, tribunal aur authority ke saamne pesh hone ka adhikar deta hai; enrolment ek State Bar Council me hota hai par right all-India hai. Isliye "kaunsa lawyer" ka jawab shehar se nahi, matter ke type aur us court-family ki familiarity se niklta hai.

"Senior Advocate" aur aam advocate me kya fark hai?

Senior Advocate ek designation hai jo High Court ya Supreme Court, Section 16 Advocates Act ke under, ability aur standing ke aadhar par deta hai (process Indira Jaising v. Supreme Court of India, 2017 ke dishanirdeshon se chalta hai). Senior Advocate seedha client se brief nahi lete — unhe ek advocate-on-record/instructing advocate ke through engage kiya jaata hai. Har acchhe matter ke liye Senior zaroori nahi hote; complexity aur stakes ye tay karte hain.

Visa reject ho gaya ya OCI/FRRO ka masla hai — kaunsa lawyer chahiye?

Immigration-visa lawyer/consultant — ye alag specialised field hai (embassy processes, FRRO, Foreigners Act). Ek criminal-adjacent apvaad: 498A jaise case me passport impound ya Look-Out Circular ka masla criminal lawyer handle karta hai, kyunki wo FIR se juda hota hai.

GST/income-tax notice ya company-trademark ka masla — kaunsa professional chahiye?

Tax notices (ASMT-10, 143(1)) me CA + tax lawyer ki jodi; company/ROC compliance me Company Secretary; trademark-copyright me IP attorney; NCLT shareholder disputes me corporate litigation lawyer. Ye sab is chamber ke practice areas se bahar hain — sahi specialist ke paas seedha jaana samay aur paisa bachata hai.

Doctor ki laparwahi (medical negligence) ka case kaun ladta hai?

Consumer-forum practice wala lawyer jo medical negligence me kaam karta ho — ye cases medical records aur expert opinion par chalte hain, aam taur par consumer commission me. (Sadak-durghatna ke muawze ka MACT claim isse alag hai — wo is site ke MACT guide me covered hai.)

Trust banana ho ya estate planning karni ho to?

Estate-planning/trust lawyer — trust ka gathan, registration aur tax-structure ek specialised documentation practice hai. Saadi vasiyat (will) aur succession certificate ke maamle alag hain — unki jaankari is site ke succession guide me hai.

Criminal aur civil lawyer me kya fark hai?

Criminal matter me State prosecute karta hai aur daanv aazadi ka hota hai — FIR, bail, trial. Civil matter me do private paksh hote hain aur daanv paisa/property/adhikar ka hota hai — suit, injunction, recovery. Kai jhagdon me dono strands saath hote hain, isliye pehle classification zaroori hai.

Cheque bounce ke liye kaunsa lawyer chahiye?

Cheque bounce Section 138 NI Act me criminal complaint ke roop me chalta hai, lekin asli maqsad paisa wapas paana hota hai — isliye ye criminal-complaint aur civil-recovery dono ka mixed matter hai, jo aam taur par ek hi chamber saath handle karta hai.

Property ke jhagde me kaunsa court jaana hota hai?

Aam property disputes (possession, partition, title, injunction) civil court me; kirayedari ke matters Haryana me Rent Controller ke paas; builder/project ki shikayat RERA me; aur registry-fraud jaisi cheez me criminal angle bhi ho sakta hai. Sahi forum ka chunaav hi aadha case hai.

Can one lawyer handle both the criminal and the civil side of my dispute?

Yes — and in overlap matters (cheque bounce, business fraud, matrimonial disputes with an FIR) it is usually better that one chamber sees the whole board, so the two tracks support rather than contradict each other.

Job ke jhagde me labour court jaana hota hai ya civil court?

Role par depend karta hai — workman-category disputes Industrial Disputes machinery aur Labour Court me jaate hain; managerial/supervisory roles ka rasta aksar civil hota hai; wages, gratuity, PF ke apne statutory forums hain. Ye classification shuru me hi karwa lena chahiye.
